SAN JUAN – An Independent Special Prosecutor (FEI) will investigate the mayor of Guayama, Eduardo Cintrón Suárez and the Finance Director of that municipality, Lilliam Rodríguez López, for alleged conduct contrary to the law committed by both officials.
The determination of the Panel on the Special Independent Prosecutor (PFEI) to carry out a thorough investigation, arises after evaluating a referral from the Department of Justice (DJPR) that, among its conclusions, recommends such a course of action.
In its Resolution of July 20, 2021, the Panel indicates that this case originated with an anonymous complaint filed with the DJPR. In said brief, it was alleged that the municipality granted a contract for the collection and disposal of solid waste, without complying with the Law of Autonomous Municipalities of Puerto Rico and in violation of the provisions of the Criminal Code of PR of 2012.
The Preliminary Investigation Report adds that the contract was awarded to the firm Mr. Waste, Inc., a corporation registered and chaired by Mr. Mario Roque Marcano.
The complaint adds that the aforementioned contract was not approved by the Guayama Municipal Legislature, nor was an auction held.
On the other hand, the report attributes to Mayor Cintrón Suárez authorizing an amendment to the contract to benefit Mr. Roque Marcano, which was prepared on the instructions of the Director of Finance.
This decision caused the illegal disbursement of hundreds of thousands of dollars of public funds, which is why it is concluded that the contract is void since it originated.
The Panel concludes in its Resolution that the record that “the DJPR sent us contains evidence conducive to demonstrating that the allegations in the aforementioned report against Eduardo Cintrón Suárez and Lilliam D. Rodríguez López could be the subject of criminal charges.
Pursuant to this conclusion, the Panel appointed Emilio Arill García as an Independent Special Prosecutor to carry out the aforementioned in-depth investigation. Likewise, it appointed Leticia Pabón Ortiz as Deputy Prosecutor.
For these purposes, they were granted a period of 90 days to carry out this task.
